Even if we were to treat Jon/Jen as if she were Milosevic, Lucas did not do anything to get surveilled, could not physically give her sword away, was innocent on the matter of people being changed and, more to the point, Brazil would have the right to treat the covert invasion as an act of WAR.
Basically, even if we assume Lilly can be surveilled that way, Lucas has her rights in Brazil, which is a sovereign country and, in-story, as a country, also had its rights violated.
